Abstract: The right to health, as an expression of the pursuit of happiness, is guaranteed by the 1988 Federal Constitution as a fundamental right of the citizen and a duty of the state. However, the increasing judicialization of health care has created significant challenges for public authorities, requiring solutions that combine procedural speed with decisions based on scientific evidence. In this context, NATJUS (Technical Support Center for the Judiciary) emerges as an essential tool for evidence-based decision-making, providing technical and scientific opinions supported by studies from renowned health institutions such as the Albert Einstein Israeli Hospital and the Sírio-Libanês Hospital. Given this scenario, this article seeks to consider to what extent the requirement of judicial expert examination in health-related claims where a NATJUS opinion has already been issued would be necessary. By analyzing the effectiveness of NATJUS as a technical support instrument, the objective is to demonstrate that this system, by itself, ensures the truth of the facts presented, since its analyses are grounded in robust scientific evidence. Thus, NATJUS not only contributes to procedural efficiency but also ensures greater precision and safety in judicial decisions related to health. Throughout the study, the relationship between human dignity, the right to health, and the pursuit of happiness will be addressed, showing how NATJUS serves as a guarantor of these rights. The approach taken aims to understand the relevance of this mechanism within the legal system, emphasizing its role in the realization of fundamental rights and in building a more efficient and evidence-based procedural system.
