A UNIVERSALIZAÇÃO DO SANEAMENTO E O SUBSÍDIO CRUZADO: CRÍTICA À PROPOSTA DE ALTERAÇÃO DAS DIRETRIZES NACIONAIS
Este estudo apresenta o panorama do subsídio no saneamento e o principal responsável por subsidiar os consumidores de baixa renda. Além disso, faz-se uma crítica à proposta de alteração das diretrizes nacionais do saneamento. Quanto ao subsídio, verificou-se que cabe ao governo a obrigação de efetivação de políticas públicas com reflexos sociais e a adoção da política de subsídios para a sociedade como um todo, já que subsidiar o alcance de serviços de saneamento para as classes de baixa renda significa redução dos custos orçamentários com saúde pública e educação, entre outros, o que implica numa economia indireta maior do que os custos da oferta do serviço. Quanto às alterações no Marco Regulatório do Saneamento, cabe destacar o interesse da União de incentivar a participação de empresas privadas no processo de universalização, o que é positivo. Porém, a forma pretendida, além das possíveis inconstitucionalidades, tende a direcionar a concentração das empresas privadas nas regiões mais atrativas, isto é, aquelas consideradas superavitárias. As empresas estatais estarão fadadas a operarem apenas os sistemas deficitários, com riscos para a operação dos sistemas como um todo, já que, sem os sistemas superavitários, os ganhos de escala decorrentes do subsídio cruzado desaparecerão. Defende-se a manutenção do subsídio cruzado sob a vigência do atual regime jurídico de concorrência pelo serviço, mediante decisão do Poder Concedente, concluindo-se que a aprovação da proposta comprometerá todo o sistema de subsídio às classes de baixa renda.

Abstract:
This paper presents the scenario of the subsidy to water supply and sanitation and the main responsible for subsidizing low-income consumers. Furthermore, it makes a criticism of the proposition of altering the national directives for water supply and sanitation services. Regarding the subsidy, we verified that the government is responsible for promoting public policies with social repercussions and adopting funding policies for society as a whole, since subsidizing the access of low-income classes to water supply and sanitation means reducing budgetary costs with public health and education, among others. This implies an indirect economy that is more significant than the costs of providing the service. Concerning the amendments to the Regulatory Framework for Water Supply and Sanitation Service, it is important to highlight the federal government’s interest in encouraging the participation of private companies in the process of universalization, which is positive. However, the intended form of doing it, besides the possible unconstitutionalities, tends to concentration of private companies in the most attractive regions, that is, those considered in surplus. The state companies will be compelled to operate only the systems in deficit, with risks for the operation of the systems as a whole, since the gains derived from the cross-subsidy will disappear in the absence of systems in surplus. We advocate the maintenance of cross-subsidy under the current legal regime of competition for the service, through decision of the Concession Authority, and we conclude that approving the alterations will compromise the entire funding system for low-income classes.
