A Uberização do trabalho e o acesso à justiça: uma análise crítica quanto a insegurança jurídica do trabalhador informal
O presente artigo visa analisar o fenômeno da uberização dentro de uma visão trabalhista, destacando qual foi o seu comportamento no mundo jurídico, em que pese, a banalização de trabalhos sem regulamentação específica e a chamada economia de bicos. Através disso, o objeto de estudo principal é a figura do motorisra da empresa Uber e as garantias que são dadas a eles, enquanto prestador de serviço autônomo, cujo trabalho não é regido pela legislação trabalhista vigente. Logo, mediante análise documental, doutrinária e jurisprudencial, chegou-se à conclusão que a solução mais viável para a lacuna da lei seria a criação de uma legislação específica que atenda as particularidades da classe trabalhadora autônoma, promovendo o acesso à justiça.

Abstract:
This article aims to analyze the phenomenon of uberization within a labor perspective, highlighting its behavior in the legal world, in spite of the trivialization of jobs without specific regulation and the so-called gig economy. Through this, the main object of study is the figure of the driver of the company Uber and the guarantees that are given to them, as an autonomous service provider, whose work is not governed by the current labor legislation. Therefore, through documental, doctrinal and jurisprudential analysis, it was concluded that the most viable solution to the gap in the law would be the creation of specific legislation that meets the particularities of the autonomous working class, promoting access to justice.
