A TRANSPARÊNCIA COMO INSTRUMENTO À EFICÁCIA MATERIAL DO DIREITO HUMANO AO DESENVOLVIMENTO
A sociedade pós-moderna tem a
comunicação como elemento característico.
Este instrumento deve ser utilizado pelo Poder
Público para satisfazer parte das necessidades
da comunidade, que hodiernamente exige
novas formas de gestão da res publica. Nesse
contexto, a transparência surge como um
instrumento à eficácia material do direito ao
desenvolvimento. Este, por seu turno, está
previsto internacionalmente e é amparado pelo
princípio constitucional da solidariedade. Não
obstante as exigências legais concernentes à
transparência, a presente pesquisa cogita de
uma atuação além dos limites legais, sempre
com a finalidade de satisfazer materialmente o
direito ao desenvolvimento. O método adotado
a este estudo foi o indutivo, e ele se realizou
mediante análise qualitativa e ampla pesquisa
bibliográfica.

Abstract:
Postmodern society has
communication as a distinctive element. This
instrument must be used by the Government
to meet part of the needs of community, which
in our times require new forms of management
res publica. In this context, transparency
emerges as an instrument to effectively stuff
the right to development. This, in turn, is
expected internationally and is supported by the
constitutional principle of solidarity. Regardless
of the legal requirements concerning the
transparency this research considering a
performance beyond legal limits, always
with the purpose of material fulfill the right
to development. The method adopted in this
study was inductive, and it was performed by
qualitative analysis and bibliographic research.
