A TRANSFORMAÇÃO DO CONCEITO DE DIREITO DE AUTOR E OS DESAFIOS DAS NOVAS TECNOLOGIAS
Desde as primeiras discussões sobre direito autoral, o conceito de autor e seus impactos no direito sobre as obras foram se alterando. Enquanto as primeiras legislações buscavam proteger o direito dos criadores das obras de maneira restrita, novas tecnologias atreladas à nova configuração da própria sociedade desafiam o modelo protetivo em relação aos direitos de autor. Para demonstrar essa mudança, este trabalho se propõe a verificar a evolução do conceito de autor, perpassando por avanços tecnológicos como a internet que incitam um olhar diferente para a proteção autoral tradicional, trazendo alguns dilemas e discussões atuais sobre a existência ou não de certos limites para caracterização como autor. Por fim, pretende-se analisar diferentes mecanismos para o enquadramento ou não de uma inteligência artificial como autora de direitos e uma possível flexibilização do conceito clássico de autor para se adequar a essa nova realidade tecnológica.

Abstract:
Since the first discussions on copyright/authors rights, the concept of authorship and its impact on the right to works have been changing. While the first laws sought to protect the rights of creators in a restricted way, new technologies linked to the new society configuration challenge the protective model regarding rights to authors. To demonstrate this transformation, this paper aims to verify the evolution of the concept of authorship, going through technological advances such as the internet that drive a different look at traditional copyright/authors right protection, bringing some current dilemmas and discussions about the existence or not of certain limits for an authorship characterization. Finally, it is intended to analyze different mechanisms to include or not an artificial intelligence as an author of rights and a possible relaxation of the classic concept of author to adapt to this new technological reality.
