A TRABALHABILIDADE DO TELETRABALHADOR: UMA ANÁLISE A PARTIR DO NÚCLEO ESSENCIAL DO DIREITO FUNDAMENTAL AO TRABALHO
O estudo incentiva o leitor a refletir sobre a realização laborativa contemporânea e, atrelado a isso, pretende-se enriquecer tal contemplação guiando-se pelo núcleo essencial do direto fundamental ao trabalho. Através do método de abordagem dialético, busca-se investigar o núcleo essencial do direito fundamental em análise, balizando-se na metamorfose social, em especial, na utilização de plataformas digitais para o labor. A par disso, almeja-se responder aos seguintes questionamentos: a atividade laboral realizada através das plataformas digitais, afasta do teletrabalhador a proteção do núcleo essencial do direito fundamental ao trabalho? A trabalhabilidade dos profissionais que teletrabalham, acentuo-se com o aumento da realização laborativa através dos meios digitais? Com o auxílio dos procedimentos tipológico-estruturalista, o artigo permeará conceitos básicos do núcleo essencial fundamental, desejando compreende-lo quando contrastada a complexidade social e as mudanças em termos de direito do trabalho, por assim dizer, sua realização. O método de interpretação empregado é o exegético, empenhando-se em contemplar a maior atenção ao trabalhador como sujeito de direito, em sua máxima condição de dignidade na execução da labuta. Valer-se-á da pesquisa qualitativa, manuseando fontes documentais e bibliográficas. No deslinde do estudo, percebe-se que a ascensão do teletrabalho que atuou como medida solucionadora para a continuação laboral mediante as limitações do momento pandêmico, permanecerá atuante em razão da nova realidade anunciada, assim como seus benefícios. Além disso, o incremento da produtividade traduziu-se na linear trabalhabilidade do teletrabalhador, não se afastando dos patamares pré-estabelecidos de dignidade em sua execução.

Abstract:
ABSTRACT The study encourages the reader to reflect on the contemporary work performance and, linked to this, it intends to enrich such contemplation guided by the essential core of the fundamental right to work. Through the method of dialectical approach, we seek to investigate the essential core of the fundamental right under analysis, based on social metamorphosis, in particular, on the use of digital platforms for work. In addition, the aim is to answer the following questions: does the work activity carried out through digital platforms remove from the teleworker the protection of the essential core of the fundamental right to work? Is the workability of professionals who telework accentuated with the increase in work performance through digital means? With the help of typological-structuralist procedures, the article will permeate basic concepts of the fundamental essential core, wishing to understand it when contrasted with social complexity and as changes in terms of labor law, so to speak, its realization. The work method is the exegetical one, striving to pay greater attention to the worker as a subject of law, in his maximum condition of dignity in the execution of the toil. It will make use of qualitative research, handling documentary and bibliographic sources. At the end of the study, it is clear that the rise of telework, which served as a solution for continuing work due to the limitations of the pandemic moment, will remain active due to the new reality announced, as well as its benefits. In addition, the increase in productivity translated into the linear workability of the teleworker, not straying from the pre-defined levels of dignity in their execution.
