A TEORIA DOS PRECEDENTES E SUA EVOLUÇÃO HISTÓRICA NO BRASIL: UMA BREVE ANÁLISE COM COMMON LAW E O CIVIL LAW
Este trabalho trata da força
dos precedentes, e a sua influência no
entendimento jurisprudencial na ordem jurídico
brasileira. E, consequentemente, levantar
os benefícios obtidos com este sistema, e
como será o mecanismo de funcionamento do
Poder Judiciário ao utilizar esta ferramenta.
Apresentar as críticas, e como estas serão
capazes de influenciar este sistema de
uniformização de jurisprudência. Identificar
os posicionamentos de maior relevância na
construção do conhecimento, em relação ao
uso dos precedentes judiciais.

Abstract:
This paper aims to present the
strength of precedents and its influence on
the jurisprudential understanding in Brazilian
legal order. And, as consequence, to raise the
benefits obtained with this system, and how will
be the mechanism of operation of the Judiciary
by using this tool. To present the criticisms and
how they will be able to influence this system
of uniformity of jurisprudence and identify the
most relevant positions in the construction
of knowledge related to the use of judicial
precedents.
