A TEORIA DA ARGUMENTAÇÃO JURÍDICA TRATADA NO CINEMA: DOZE HOMENS E UMA SENTENÇA
Este artigo procura demonstrar como
a Teoria da Argumentação foi tratada no cinema,
através do filme estadunidense 12 Angry Men,
de 1957, drama traduzido como Doze homens
e uma sentença, onde um jovem, acusado de
assassinar o próprio, vai a julgamento. O filme
expõe aos telespectadores como, através
da racionalidade, é possível fundamentar
a condenação ou a absolvição de alguém,
com os melhores argumentos existentes. Na
sistemática norteamericana, o veredicto do
júri deve ser unânime, seja para condenar ou
para absolver, é preciso alcançar a certeza da
decisão ou a maior probabilidade disto. A Teoria
da Argumentação Jurídica trata das teorias que
estudam os métodos de argumentação jurídica.
O filme se desenrola na análise do fato através
do estudo das provas do crime, buscando um
argumento forte para condenar ou absolver, mas
não sem abordar os subjetivismos dos jurados,
cada qual com sua personalidade, moral,
filosofia e carga emocional. Diante do mesmo
fato, como um jurado absolve e outro condena
o acusado? Assim, a Teoria da Argumentação
e seus autores tentam demonstrar ao juiz que
é possível aplicar o melhor argumento para a
solução correta de um caso, sólido e forte o
bastante, mesmo diante de casos difícei.

Abstract:
This article seeks to demonstrate
how the Theory of Argumentation was treated in
the cinema through the American film 12 Angry
Men, 1957, a drama translated as Twelve Men
and a Sentence where a young man is accused
of murdering his own father, goes to trial. The
film exposes viewers how, through rationality,
it is possible to base the condemnation or
acquittal of someone with the best arguments. In
the American system, the jury’s verdict must be
unanimous, whether to condemn or to acquit, it is
necessary to reach the certainty of the decision
or the greater probability of this. The Theory of
Legal Argumentation deals with theories that
study methods of legal argumentation. The film
unfolds in the analysis of the fact through the
study of the evidence of the crime, seeking a
strong argument to condemn or absolve, but not
without addressing the subjectivisms of jurors,
each with its personality, moral, philosophy and emotional load. Faced with the same
fact, as one jury acquits and another convicts the accused? Thus, Argumentation
Theory and its authors try to demonstrate to the judge that it is possible to apply the
best argument for the correct solution of a case, solid and strong enough, even in the
face of difficult cases.
