A RESPONSABILIDADE DOS AGENTES PÚBLICOS PELA OMISSÃO ESTATAL
Este artigo aborda a responsabilidade dos agentes públicos quando, por descumprimento de seu dever legal, acabam por ser omissos frente a sociedade. Analisa o conceito de responsabilidade e, diante da omissão, levanta o questionamento de quem é o responsável pelos danos ocasionados, se é o Estado ou se a responsabilidade está diretamente ligada aos agentes públicos por ocuparem cargos e, nesta condição, exercerem função pública. Para tanto, se parte do evento fatídico ocorrido com o menino Bernardo na cidade de Três Passos, Rio Grande do Sul e, mesmo sem entrar no mérito do processo judicial, se supõe que os fatos narrados por testemunhas indicam a omissão estatal, já que, em tese, o desfecho danoso poderia ter sido evitado. Também se aborda quem poderá ser demandado em ação de responsabilidade civil por omissão, se diretamente apenas o Estado e regressivamente os agentes, entendimento este do STF, ou também o agente, como exposto por alguns autores. Finalmente, para fechar a exposição, se argumenta que a omissão, em última instância, representa ineficiência do Estado e, portanto, mesmo que funcionalmente, deveria ocorrer a responsabilização do agente.

Abstract:
This article addresses the responsibility of public agents when, for non-compliance with their legal duty, end up being omissive towards society. Analyzes the concept of responsibility and, in the face of omission, raises the question of who is a responsible for the damages caused, whether it is the state or whether responsibility is directly linked to public officials for occupying positions and, in this condition, exercising public function. For that, if part of the fateful event that occurred with the boy Bernardo in the city of Três Passos, Rio Grande do Sul and, even without going into the merits of the judicial process, it is assumed that the facts narrated by witnesses indicate the state failure, since, in theory, the damaging outcome could have been avoided. Also addresses who can be sued in civil liability action for omission, if directly only the state and regressively the agents, understanding of the STF, or also the agent, as exposed by some authors. Finally, to close the exhibition, it is argued that the omission, in the last instance, represents inefficiency of the State and, therefore, even functionally, the agent should be held accountable.
