A RESPONSABILIDADE CIVIL DOS FILHOS NO ABANDONO AFETIVO INVERSO
o presente artigo tem a finalidade de apurar a possibilidade jurídica de responsabilização aos que cometem o abandono afetivo inverso, cujas vítimas são os idosos afetivamente e estruturalmente desamparados por suas famílias, bem como o papel do Estado em face aos direitos básicos dos idosos para garantia de uma vida digna. Por meio do método dedutivo e ampla pesquisa teórica, embasada em material bibliográfico, com ênfase na Constituição Federal Brasileira, Código Civil e Estatuto do Idoso, buscou-se entender as obrigações da entidade familiar, com base no princípio da dignidade da pessoa humana, analisando a importância do afeto dentro dos laços familiares e os efeitos resultantes desse.

Abstract:
the purpose of this article is to investigate the legal possibility of liability to those who commit reverse affective abandonment, whose victims are the elderly who are emotionally and structurally helpless by their families, as well as the role of the State in relation to the basic rights of the elderly to guarantee a dignified life. Through the deductive method and extensive theoretical research, based on bibliographic material, with emphasis on the Brazilian Federal Constitution, Civil Code and Statute of the Elderly, we sought to understand the obligations of the family entity, based on the principle of human dignity, analyzing the importance of affection within family ties and the resulting effects.
