A RELEVÂNCIA DO USO DE ALGEMAS NA ATIVIDADE POLICIAL SOB A PERSPECTIVA CONSTITUCIONAL E LEGAL
A legitimidade do uso de algemas é um tema bastante relevante, mas ganhou maior importância recentemente, com a edição da Súmula Vinculante nº 11 do Supremo Tribunal Federal, que restringiu o emprego de algemas, tornando a sua utilização uma medida excepcional e exigindo justificativa da autoridade, por entender que o seu uso fere a dignidade da pessoa humana. O presente trabalho acadêmico foi realizado através da pesquisa bibliográfica, tendo em vista a necessidade de contextualização como forma de se chegar a uma melhor compreensão acerca do tema. Para isso será feita uma análise do emprego de algemas, abrangendo o seu conceito bem como os preceitos que devem ser observados quando da necessidade de se algemar, como a integridade física do policial, de terceiros e do próprio preso. Por falta de uma regulamentação específica sobre o tema, será analisada a legislação brasileira usada para subsidiar o correto emprego desse instrumento. Visando suprir essa lacuna, o enunciado nº 11 foi editado, mas como se verá, há que se questionar se sua criação respeitou os limites constitucionais, elencando-se as decisões que ensejaram a sua origem. No mais, ainda será abordada a importância que o emprego desse aparato exerce durante a atividade policial, e que a decisão sobre o seu emprego cabe aos agentes de segurança, uma vez que não se pode subtrair deles a discricionariedade, que é inerente à sua atuação com o objetivo de manter a ordem pública e não tornar a segurança da coletividade ainda mais frágil do que se encontra no cenário atual.

Abstract:
The legitimacy of the use of handcuffs is a very important issue, but has gained more importance recently with the issue of Binding Precedent 11 of the Supreme Court, which restricted the use of handcuffs, making its use as an exceptional measure and requiring justification for authority , understanding that its use hurts the dignity of the human person. This academic work was carried out through literature, in view of the need for contextualization as a way to reach a better understanding of the subject. For this will be a historical analysis of the use of handcuffs, covering the concept and symbolism, as well as the principles that should be observed when the need to handcuff, as the physical integrity of the police, third and the prisoner himself. For lack of a specific regulation on the subject, Brazilian law used to subsidize the correct use of this instrument will be examined. Aiming to fill this gap, the statement No. 11 was issued, but as you will see, we have to question whether its creation respected the constitutional limits, if elencando- decisions that gave rise to its origin. In most, the importance that the use of this apparatus performs during the police activity will be further addressed and that the decision on its use is up to security guards, since they can not escape their discretion, which is inherent in its operations in order to maintain public order and not make security even more fragile community than is the current scenario.
