A RELAÇÃO DE TRABALHO ENTRE A UBER E SEUS “PARCEIROS”: O MOTORISTA ANTÔNIO
As novas tecnologias de aplicativos como a Uber são uma nova técnica utilizada pelas sociedades empresárias para organizar a mão de obra. Por sua novidade, essas relações apresentam um desafio para o direito do trabalho brasileiro: a reinvenção. Seja para enquadrar a relação dos motoristas “parceiros” com a Uber como uma relação de emprego, seja para criação de um novo instituto jurídico capaz de englobá-los, fato é que essa nova categoria de trabalhadores não pode ficar à margem do ordenamento jurídico trabalhista, o qual tem por fundamento o princípio da proteção. O presente estudo realizou entrevistas com o motorista Antônio e analisou as informações disponíveis no aplicativo e no site da Uber para o referido parceiro, com o objetivo de verificar como esse tipo de serviço é executado e qual grau de autonomia resta a essa categoria de trabalhadores.

Abstract:
New application technologies like Uber are a new technique used by business companies to organize the workforce. Due to their innovation, these relationships present a challenge to Brazilian labor law: a reinvention. Whether it is to frame a employetment relationship between drivers and Uber , or to create a new legal institute capable of include them in the legal system, the fact is that this new category of workers cannot be excluded of the labor law, which based on the fundamental protection principle. This study realized interviews with a Uber driver and analyzed the information available on the app and on the Uber website for this partner, with the aim of verifying how this type of service is performed and what degree of autonomy remains for this category of workers.
