A REALIDADE DO PRINCÍPIO DA DIGNIDADE DA PESSOA HUMANA: NA EXECUÇÃO DA PENA PRIVATIVA DE LIBERDADE DA MULHER TRANSEXUAL
Este presente artigo tem como foco principal o estudo acerca da
realidade do Princípio da Dignidade da Pessoa Humana na Execução da pena
privativa de liberdade da mulher transexual, com a pretensão de discutir sobre
a situação da mulher transexual no cárcere brasileiro, considerando que elas
são amparadas pelo princípio da dignidade defendido pelo Art. 1º da
Constituição de 1988 e complementado pelo Art. 5º da mesma Carta Magna.
Nesse contexto visa traçar os principais pontos sobre esse tema que é uma
realidade ainda pouco discutida em nosso país. Esclarecendo as questões
problema como os direitos conquistados pelas pessoas transexuais no Brasil,
se eles são efetivados ou reconhecidos nos estabelecimentos prisionais, a
forma de tratamento da identidade de gênero na execução da pena.

Abstract:
This present article has as its main focus the study about the
reality of the Principle of the Dignity of the Human Person in the Execution of
the custodial sentence of the transsexual woman, with the intention of
discussing the situation of the transsexual woman in the Brazilian prison,
considering that they are supported by the principle of dignity defended by Art. 1
of the 1988 Constitution and complemented by Art. 5 of the same Magna Carta.
In this context, it aims to outline the main points on this topic, which is a reality
that is still little discussed in our country. Clarifying the problem issues such as
the rights conquered by transsexual people in Brazil if they are enforced or
recognized in prisons, the form of treatment of gender identity in the execution
of the sentence.
