A PROTEÇÃO JURÍDICA DOS DIREITOS HUMANOS E O COMBATE À VIOLÊNCIA POLÍTICA: ANÁLISE DOS MECANISMOS LEGAIS E INSTITUCIONAIS NO BRASIL

O presente artigo tem como objetivo analisar a efetividade dos mecanismos legais e institucionais existentes no Brasil para a proteção dos direitos humanos no contexto da violência política de gênero, com foco na prevenção, repressão e responsabilização desses atos. Para tanto, será realizado um estudo de dispositivos legais, como a Lei nº 14.192/21 e tratados internacionais ratificados pelo Brasil. Além da análise do papel de instituições como o Ministério Público e as Defensorias Públicas, avaliando sua eficácia na promoção e proteção desses direitos. A partir de uma abordagem interdisciplinar e com foco na promoção de um ambiente democrático inclusivo, o estudo examina a ausência de garantias efetivas e os desafios estruturais que limitam a atuação feminina no espaço político. A análise propõe, ainda, a necessidade de aprimoramento das legislações existentes e a criação de novos instrumentos jurídicos que assegurem a proteção das mulheres na política e a prevenção dessa violência.

  • Abstract: The present article aims to analyze the effectiveness of the legal and institutional mechanisms in place in Brazil for the protection of human rights in the context of gender-based political violence, with a focus on the prevention, repression, and accountability of such acts. To this end, it will examine legal provisions such as Law No. 14,192/21 and international treaties ratified by Brazil, as well as analyze the role of institutions such as the Public Prosecutor’s Office and Public Defender’s Offices, assessing their effectiveness in promoting and protecting these rights. Through an interdisciplinary approach and with an emphasis on fostering an inclusive democratic environment, the study examines the absence of effective safeguards and the structural challenges that limit women’s participation in the political sphere. The analysis also proposes the need to improve existing legislation and create new legal instruments to ensure the protection of women in politics and the prevention of such violence.
