A POSSIBILIDADE DE SUSPENSÃO DAS MÚLTIPLAS MEDIDAS SANCIONATÓRIAS INSTAURADAS SOB O MESMO CONTEXTO FÁTICO-PROBATÓRIO COMO CAMINHO PARA MINORAR OS RISCOS DO BIS IN IDEM
O estudo investiga o campo de incidência do Direito Penal e do Direito Administrativo Sancionador. Valendo-se do método dedutivo, partindo da premissa da existência de um macrossistema punitivo e sua necessária coerência. No estado da arte evidenciou-se uma nova vertente do Supremo Tribunal Federal sobre o assunto, permitindo edificar-se uma nova premissa e o questionamento sobre a possibilidade de suspensão das múltiplas medidas sancionatórias instauradas sob o mesmo contexto fático-probatório quando houver simultâneo escrutínio criminal de idêntico acervo, com a finalidade de para minorar os riscos da ocorrência do bis in idem.

Abstract:
The study investigates the scope of Criminal Law and Sanctioning Administrative Law. Using the deductive method, starting from the premise of the existence of a punitive macrosystem and its necessary coherence. In the state of the art, a new aspect of the Federal Supreme Court on the subject was evidenced, allowing a new premise and questioning about the possibility of suspending the multiple sanctioning measures instituted under the same factual and evidential context when there is simultaneous criminal scrutiny. of identical collection, in order to reduce the risks of the occurrence of bis in idem.
