A POSSE COMO INSTRUMENTO DE REGULARIZAÇÃO FUNDIÁRIA: UMA ANÁLISE DA LEGISLAÇÃO DAS TERRAS DEVOLUTAS MINEIRAS
A regularização fundiária é
instrumento correlato à promoção da cidadania,
que está diretamente ligado à efetivação do
direito social fundamental à moradia digna. No
entanto, a realidade mineira demonstra que a
irregularidade fundiária é regra, especialmente
no interior, atingindo também as terras devolutas
estaduais. Nesse contexto, o presente trabalho
busca demonstrar que a política pública mineira
voltada para a regularização de terras devolutas
mostra-se inadequada em comparação
com a atual política nacional, no que tange
a valorização da posse como instrumento
efetivador do direito à moradia. A sistemática
do artigo consiste na verificação da relevância
da posse na regularização das terras devolutas
a partir do estudo da legislação mineira, na
apresentação dos argumentos contrários à
valorização da posse, e na demonstração
dos benefícios da função social da posse em
relação à garantia de acesso democrático ao
direito social fundamental à moradia digna.

Abstract:
The land regularization is essential
to the promotion of the citizenship, which is
linked to the fundamental right to housing.
However, the reality of the Minas Gerais State
shows that irregularity rules, especially at the
country, and also reaches the vacant lands.
In this context, the present work intends to
demonstrate that the public politics of the
Minas Gerais State turned to the vacant lands
regularization is inappropriate, in comparison to
the national politics of nowadays, considering
the possession as an instrument that ensures
the right to housing. The article’s systematic
consists in verify which relevance is given to the
possession on legal regularization by studying
the Minas Gerais’ law, bringing up the opposite
arguments to the possession valorization,
demonstrating the possession’s social function
benefits in order to guarantee the democratic
access to the human right to housing.
