A POSIÇÃO JURÍDICO-POLÍTICA DO PODER JUDICIÁRIO SOBRE A QUESTÃO AGRÁRIA: UM ESTUDO SOBRE A VIOLENTA ORDEM DE DESPEJO DO CENTRO DE FORMAÇÃO PAULO FREIRE EM NORMANDIA EM CARUARU-PE
O presente artigo tem por objetivo geral discutir os elementos políticos, jurídicos, sociais e filosóficos acerca das motivações do INCRA - Instituto Nacional de Colonização e Reforma Agrária, acionar a Justiça Federal, com o fito de injustamente, desocupar, por meio de uma Ordem Judicial de Despejo, do Centro de Formação Paulo Freire pessoa jurídica denominada de Associação do Centro de Capacitação Paulo Freire - ACCPF, localizado na conhecida popularmente Fazenda Normandia área de assentamento do MST, no município de Caruaru-PE, um dos mais organizados e importantes assentamentos ligados ao Movimento dos Trabalhadores Rurais Sem Terra. Foram objetivos específicos: 1. Sistematizar dados qualitativos, acerca da disputa judicial pela desocupação do Centro de Formação Paulo Freire, em Caruaru, partindo dos pressupostos subjetivos, da participação democrática e social, da referida decisão judicial. 2. Refletir os efeitos mediatos da injusta decisão judicial que outrora determinara a desocupação. 3. Estudar os efeitos da desobediência civil na arena política e jurídica e 4. Analisar a função social e democrática do Movimento Social e sua integração ao direito achado na rua.

Abstract:
The general objective of this article is to discuss the political, legal, social and philosophical elements about the motivations of INCRA - National Institute of Colonization and Agrarian Reform, to sue the Federal Justice, with the aim of unfairly, vacating, through a Judicial Eviction Order, from the Paulo Freire Training Center legal entity called the Association of the Paulo Freire Training Center - ACCPF, located in the popularly known Normandy Farm settlement area of the MST, in the municipality of Caruaru-PE, one of the most organized and important settlements linked to the Landless Rural Workers Movement. The specific objectives were: 1. To systematize qualitative data about the legal dispute over the eviction of the Paulo Freire Training Center, in Caruaru, based on the subjective assumptions, democratic and social participation, of the referred judicial decision. 2. Reflect the mediating effects of the unjust judicial decision that once determined the eviction. 3. Study the effects of civil disobedience in the political and legal arena and 4. Analyze the social and democratic function of the Social Movement and its integration with the right found on the street.
