A perversão da lei: análise do livro A Lei de Frédéric Bastiat
O livro A Lei de Frédéric Bastiat é
considerado um clássico do liberalismo e foi
escrito no contexto da revolução francesa
ainda no século 19. O autor tece duras críticas
quanto ao uso, por parte dos legisladores
(que se encontravam não a serviço do povo,
mas sim aos interesses de suas respectivas
classes), da formulação das leis que de alguma
forma acabariam favorecendo-os. Atualmente,
na sociedade brasileira, podem-se notar
semelhanças no que diz respeito à formulação
de algumas leis que servem como aparato da
injustiça utilizando-se da força do Estado. O uso
da legitimidade da lei dificilmente é questionada
e por isso, muitos usam-na de forma a alcançar
fins que distorcem completamente não só
o sentido como também o fundamento que
a norma e o próprio ordenamento jurídico
estabelece. A justiça, antes buscada e positivada
nas leis, virtude que a ciência do Direito tanto
presa, é completamente obscurecida pelo texto
normativo, sendo que o escopo da lei não é mais
o justo, mas sim o benefício, principalmente
daqueles interessados na formulação e
aprovação de uma lei. Porém, usando da lei
e da força estatal, tal ação é transformada em
ferramenta para a escravidão, não só física
como também a moral. Isso, segundo BASTIAT
(2010, p. 14), é o caminho preferível pelos
homens que fogem da dor e buscam viver
um às expensas dos outros. Constantemente,
muitos cidadãos se veem em uma condição
insustentável ao se depararem com leis que
não fazem sentido e só estão em vigor por
interesses de terceiros. Mesmo com normas
constitucionais que dão poderes à coletividade
de lutar contra a tirania de leis completamente
perversas, por falta de conhecimento ou até
pela necessidade do cumprimento de certos
quesitos para tal, a população brasileira acaba
refém de um legislativo corrompido que não
cumpre sem papel como representante do povo,
mas sim como representante dos interesses
que lhes são convenientes.

Abstract:
The book Frédéric
Bastiat’s Law is considered a classic of liberalism and was written in the context of
the French revolution in the 19th century. The author makes harsh criticism of the use
by legislators (who were not in the service of the people but rather to the interests
of their respective classes), the formulation of laws that would in some way end up
favoring them. Currently, in Brazilian society, similarities can be noted with respect to
the formulation of some laws that serve as an apparatus of injustice using the force of
the state. The use of the legitimacy of the law is hardly questioned and so many use
it to achieve ends that completely distort not only the meaning but also the foundation
that the norm and the legal order it self lays. Justice, previously sought and positivized
in the laws, because the science of the law is so trapped, is completely obscured by
the normative text, and the scope of the law is no longer just, but the benefit, especially
those interested in the formulation and approval. of a law. However, using law and
state force, such action is transformed into a tool for slavery, not only physical but also
moral. This, according to BASTIAT (2010, p. 14), is the preferable path for men who
escape pain and seek to live at the expense of others. Constantly, many citizens find
themselves in an unsustainable condition when they come across laws that make no
sense and are only enforced by the interests of others. Even with constitutional norms
that empower the collective to fight against the tyranny of completely perverse laws,
due to lack of knowledge or even the need to comply with certain requirements, the
Brazilian population is held hostage by a corrupt legislature that does not fulfill its role
representative of the people, but rather as a representative of their interests.
