A PERSPECTIVA CONSTITUCIONAL ACERCA DA FUNÇÃO SOCIOAMBIENTAL DA PROPRIEDADE DOS BENS DE PRODUÇÃO
O modo de produção do sistema capitalista, possibilitou o desenvolvimento socioeconômico do Brasil, consequentemente provocou demasiados impactos ambientais. Diante disso, o presente artigo, a partir da pesquisa qualitativa buscou fazer um levantamento de referencial através da pesquisa bibliográfica, com vistas a compreender os motivos que levaram o ordenamento jurídico brasileiro a consagrar a função socioambiental como preceito basilar das propriedades de bens de consumo. Partindo, portanto, da hipótese que é preciso mais do que a simples observação aos dispositivos normativos. Assim, concluiu que, mesmo o país possuindo expressivas legislações, ainda há um notório imbróglio na adoção de políticas ambientais mais ríspidas pelo receio de enfraquecimento do desenvolvimento empresarial do país.

Abstract:
The mode of production of the capitalist system, made possible the socioeconomic development of Brazil, consequently causing too many environmental impacts. In view of this, this article, based on qualitative research, sought to conduct a referential survey through bibliographic research, with a view to understanding the reasons that led the Brazilian legal system to enshrine the socio-environmental function as the basic precept of consumer goods properties. Therefore, starting from the hypothesis that it is necessary more than the simple observation of the normative devices. Thus, he concluded that, even though the country has significant legislation, there is still a notorious imbroglio in the adoption of stricter environmental policies for fear of weakening the country's business development.
