A ORIGEM E A EVOLUÇÃO DOS DIREITOS DA PERSONALIDADE E A SUA TUTELA NO ORDENAMENTO JURÍDICO BRASILEIRO
O propósito da presente pesquisa é analisar a evolução histórica dos direitos da personalidade, conquistados ao longo dos séculos, desde os primórdios da Grécia Antiga, Império Romano até os dias atuais, quando já consagrados na Constituição Federal do Brasil de 1988. Maior ênfase será dada à análise doutrinária dos direitos fundamentais previstos no texto constitucional que tutelam os direitos da personalidade no art. 5º, e incisos e arts. 11 ao 21, do Código Civil Brasileiro que preservam os direitos da pessoa humana enquanto sujeito de direito. Para um melhor entendimento sobre os direitos da personalidade positivados no ordenamento jurídico brasileiro, os capítulos foram divididos em ordem cronológica desde origem naturalista até a atual concepção como princípios fundamentais tutelados na nossa Magna Carta.

Abstract:
The purpose of this research is to analyze the historical evolution of personality rights, conquered over the centuries, from the beginnings of Ancient Greece, Roman Empire to the present day, when already enshrined in the Federal Constitution of Brazil of 1988. Greater emphasis will be given to the doctrinal analysis of the fundamental rights foreseen in the constitutional text that protect the rights of the personality in art. 5th, and items and arts. 11 to 21, of the Brazilian Civil Code that preserve the rights of the human person as a subject of law. For a better understanding of the rights of the personality established in the Brazilian legal system, the chapters were divided in chronological order from naturalist origin to the current conception as fundamental principles protected in our Magna Carta.
