Abstract: At the end of the 20th century and the beginning of the 21st century, Brazil began to focus on legal and criminological studies aimed at finding the best measures to prevent family and domestic violence, protect women and punish the aggressor, seeking mechanisms and actions affirmatives aimed at eradicating violations of women's rights. In this context, the Brazilian legislator enacted Law No. 11,340/06, known as the Maria da Penha Law. In this work, we seek to analyze the new change promoted by Law No. 14,550/23, in which, as of its publication, art. 19 plus §§ 4, 5 and 6, and art. 40-A, which regulate the granting and maintenance of urgent protective measures, as well as their application, as from the publication of the recent amendment, the Maria da Penha Law must be applied in all hypotheses outlined in its art. 5th, regardless of the cause or motivation of the acts of violence and the condition of the offender or victim, it is crucial, in this section, to analyze the expansion (or apparent expansion) of the use of protective measures and their application scenario in the criminal and criminal procedural sphere . After such a digression, it is worth asking to what extent the changes promoted by Law No. 14,550/23 imply the binding of the granting of the urgent protective measure within the scope of the Maria da Penha Law. To fulfill this aim, through a phenomenological approach, as a critical review of the central themes transmitted by the philosophical tradition through language, the monographic method is adopted and, as a research technique, indirect documentation, notably bibliographic and legislative research, using systematic interpretation and the teleological method.
