A NOVA CURATELA DO ESTATUTO DA PESSOA COM DEFICIÊNCIA, UMA QUESTÃO DE DIGNIDADE DA PESSOA HUMANA
Por meio do método dedutivo e da técnica da abordagem bibliográfica, o presente artigo trata de um breve histórico sobre a loucura, apresenta uma amostra brasileira sobre a literatura da loucura nos séculos XIX, XX e XXI e propõe a leitura da Convenção sobre os Direitos das Pessoas com Deficiência de Nova York, com força de emenda Constitucional desde 2009 no Brasil, como apta a permitir a superação da antinomia real existente entre o Estatuto da Pessoa com Deficiência e o Código de Processo Civil, no tocante ao assunto interdição/curatela, oferecendo uma interpretação dedutiva constitucional que favoreça à pessoa com deficiência a densidade da garantia da dignidade da pessoa humana.

Abstract:
Using the deductive method and the bibliographic approach technique, this article deals with a brief history of madness, presents a Brazilian sample of the madness literature in the 19th, 20th and 21st centuries and proposes the reading of the New York Convention. , with Constitutional amendment strength since 2009 in Brazil, able to overcome the real antinomy existing between the Statute of the Disabled and the Code of Civil Procedure regarding the interdiction / Trusteeship issue, offering a constitutional deductive interpretation that favors the person with disabilities the density of the guarantee of the dignity of the human person.
