A NORMATI(LI)ZAÇÃO DO QUESTÃO INDÍGENA: UMA ANÁLISE DO DISCURSO CONSTITUCIONAL DE 1988
A Constituição Federal de 1988 foi promulgada com a finalidade de garantir a todos os direitos fundamentais, inclusive traçando capítulo próprio para tratar em especial dos direitos dos povos indígenas. Assim, o objetivo deste trabalho é problematizar e analisar o discurso constitucional que discorre sobre os possíveis direitos dos povos indígenas no Brasil. Parte-se de uma abordagem analítica transdisciplinar que concilia teorias da língua(gem) advindas da Análise do Discurso de origem francesa, somada ao procedimento metodológico da arqueogenealogia foucaultiana, as reflexões trazidas por Pêcheux e os estudos culturais e decoloniais. Tem-se por hipótese a análise da existência de um discurso normati(li)zador que atinge o sujeito indígena, e atinge sua identidade no bojo da sociedade brasileira, tendo em vista os saberes históricos (des)qualificados pelos jogos de verdade, corroborados pelo discurso jurídico constitucional. E questiona-se a ocorrência de uma ilusão de garantia de direitos.

Abstract:
The Federal Constitution of 1988 was enacted with the aim of guaranteeing all fundamental rights, including drawing up its own chapter to deal in particular with the rights of indigenous peoples. Thus, the objective of this work is to problematize and analyze the constitutional discourse that discusses the possible rights of indigenous peoples in Brazil. It starts with a transdisciplinary analytical approach that reconciles theories of language (gem) arising from Discourse Analysis of French origin, added to the methodological procedure of Foucauldian archeogenealogy, the reflections brought by Pêcheux and cultural and decolonial studies. The hypothesis is the analysis of the existence of a normative(li)zing discourse that affects the indigenous subject, and reaches his identity in the midst of Brazilian society, in view of the historical knowledge (dis)qualified by the games of truth, corroborated by the constitutional legal discourse. And the occurrence of an illusion of guarantee of rights is questioned.
