A NECESSIDADE DE EFICÁCIA E ADEQUAÇÃO DAS NORMAS LEGAIS EM RELAÇÃO AOS AGRICULTORES FAMILIARES - O CASO DO KOCHKÄSE, NO VALE DO ITAJAÍ (SC).
Este artigo tem por objetivo verificar a adequação e eficácia da lei em relação aos agricultores familiares, analisando o caso do Kochkäse no Vale do Itajaí, SC, por intermédio de análise bibliográfica, etnográfica e documental. O queijo Kochkäse, artesanalmente produzido por agricultores familiares do Vale do Itajaí, SC, com leite cru, de acordo com o método tradicional transmitido pelos ancestrais germânicos, não pode ser comercializado ante a proibição legal. A lei não respeita a condição sociocultural do agricultor familiar e não contempla o modo de saber fazer. Falta à norma jurídica a eficácia e adequação à realidade do agricultor familiar. A antropologia do direito vem em auxílio, objetivando acabar com a lacuna existente, tentando adaptar a lei à verdadeira situação sociocultural do agricultor familiar.

Abstract:
This article aims to verify the adequacy and effectiveness of the law in relation to family farmers, analyzing the case of Kochkäse in Vale do Itajaí, SC, through bibliographic, ethnographic and documentary analysis. Kochkäse cheese, handcrafted by family farmers in the Vale do Itajaí, SC, with raw milk, according to the traditional method transmitted by Germanic ancestors, cannot be marketed under the legal prohibition. The law does not respect the socio-cultural condition of the family farmer and doesn´t contemplate the way of knowing how to do it. The legal standard lacks the effectiveness and adequacy to the reality of the family farmer. The anthropology of law comes to the aid, aiming to close the existing gap, trying to adapt the law to the true socio-cultural situation of the family farmer.
