A MÍDIA COMO CRIADORA DA NECESSIDADE DO DIREITO PENAL DO INIMIGO E A FILOSOFIA UBUNTU COMO ESSENCIA DE UMA SOCIEDADE HUMANIZADA
O presente trabalho tem por objetivo realizar uma análise sobre a necessidade criada pela mídia à aplicação de um direito penal mais agressivo. Para desenvolver o estudo buscou-se tratar sobre Direito Penal do inimigo, teoria apresentada por Günther Jakobs, em 1985, em um congresso de penalista na Alemanha. O qual mais tarde, por volta de 1999, amadureceu a teoria e apresentou nos modelos em que hoje é discutida. De lá para cá a teoria Jakobiana recebeu mais críticas do que adeptos. Para isso o tipo de pesquisa utilizada será a teórica, utilizando autores nacionais e estrangeiros. O método aplicado será o indutivo. Partindo da afirmação de que a mídia gera necessidades para sociedade, pretende-se demonstrar, com o atual estudo, que a força midiática aliada à filosofia ubuntu traria enorme contribuição à sociedade hodierna. Conclui-se que o Direito Penal do Inimigo vem ganhando força na sociedade, sobretudo pela atuação da mídia que, por ser um produto mercantil com maior força de venda, ressalta a violência, enquanto essa mesma mídia não realça a humanização de igual forma. Finaliza-se com a certeza de que é possível uma mudança de paradigma midiático, com maior enfoque no aspecto humanista.

Abstract:
This paper aims to analyze the need created by the media to apply a more aggressive criminal law. In order to develop the study it was tried to treat on Criminal Law of the enemy, theory presented by Günther Jakobs, in 1985, in a congress of penalist in Germany. Which later, around 1999, matured the theory and presented in the models in which it is discussed today. Since then the Jakobian theory has received more criticism than adherents. For this, the type of research used will be theoretical, using national and foreign authors. The applied method will be the inductive one. Based on the assertion that the media generates needs for society, it is intended to demonstrate, with the current study, that the media force allied to the ubuntu philosophy would bring enormous contribution to modern society. It is concluded that the Criminal Law of the Enemy has been gaining strength in society, especially by the media, which, as a commercial product with greater sales force, stresses violence, while the same media does not enhance humanization in the same way.
It ends with the certainty that a change in the media paradigm is possible, with a greater focus on the humanist aspect.
