A MEDICINA BASEADA EM EVIDÊNCIAS COMO SUPORTE PARA A JUDICIALIZAÇÃO DA SAÚDE NO BRASIL
Este artigo se propõe a um estudo exploratório sobre a judicialização da saúde no Brasil, sob o prisma da medicina baseada em evidências. O método utilizado foi o analítico-dedutivo, sendo que a pesquisa valeu-se de material bibliográfico, artigos científicos, legislação, doutrina e jurisprudência. Examinou-se as bases do direito à saúde existentes na Constituição Federal de 1988. Discorreu-se sobre o compromisso da Medicina Baseada em Evidências com a plena realização da saúde na gestão pública. Por fim, a judicialização da saúde da Medicina Baseada em Evidências, considerando também a jurisprudência em torno do assunto. Para tanto, utilizou-se o método dedutivo e procedimento de pesquisa bibliográfico e documental, este último focando a jurisprudência do Conselho Nacional de Justiça, do Superior Tribunal de Justiça e Supremo Tribunal Federal. A contribuição esperada com o artigo é sobrelevar a importância do suporte científico para a decisão judicial.

Abstract:
This article proposes an exploratory study on the judicialization of health in Brazil, under the prism of evidence-based medicine. The method used was the analytical-deductive one, and the research used bibliographic material, scientific articles, legislation, doctrine and jurisprudence. The foundations of the right to health in the Federal Constitution of 1988 were examined. The evidence on the basis of Evidence-Based Medicine with the full realization of health in public management was discussed. Finally, the judicialization of health in Evidence-Based Medicine, also considering the jurisprudence around the subject. For this, the deductive method and bibliographic and documentary research procedure was used, the latter focusing on the jurisprudence of the National Council of Justice, the Superior Court of Justice and the Supreme Federal Court. The expected contribution with the article is to highlight the importance of scientific support for the judicial decision.
