A MEDIAÇÃO PRÉ-PROCESSUAL COMO MÉTODO DE DESJUDICIALIZAÇÃO DE CONFLITOS
O presente estudo tem por objetivo analisar a efetividade da mediação pré-processual realizada em um Centro de Resolução Consensual de Conflitos – CEJUSC de uma Instituição de Ensino Superior da cidade de Teixeira de Freitas/BA como um método de resolução de conflitos, bem como sua eficácia para a desjudicialização das demandas e redução da litigiosidade. Em seu percurso metodológico, a pesquisa fez uso de instrumentos bibliográficos, documental e entrevistas semiestruturadas. Ao término do estudo, foi possível aferir que os sujeitos da pesquisa entendem como relevante a mediação pré-processual realizada no já mencionado CEJUSC. A mediação pode ser compreendida como uma ferramenta que traz vantagens para os mediandos, diante da resolução mais célere do conflito, bem como por lhes propiciar um reestabelecimento de possíveis relações rompidas ou em risco de rompimento.

Abstract:
This study aims to analyze the effectiveness of pre-procedural mediation carried out in a Consensual Conflict Resolution Center - CEJUSC of a Higher Education Institution in the city of Teixeira de Freitas/BA as a method of conflict resolution, as well as its effectiveness in the removal of the courts of claims and reduction of litigation. In its methodological path, the research made use of bibliographic instruments, documents and semi-structured interviews. At the end of the study, it was possible to verify that the research subjects understand the pre-procedural mediation performed in the aforementioned CEJUSC as relevant. Mediation can be understood as a tool that brings advantages to the mediators, given the quicker resolution of the conflict, as well as providing them with a reestablishment of possible broken relationships or those at risk of breaking up.
