A MEDIAÇÃO COMO MÉTODO ADEQUADO DE RESOLUÇÃO DE CONFLITOS NA SEARA FUNDIÁRIA NA AMAZÔNIA
Considerando o ingresso da mediação como forma de resolução de conflitos no ordenamento jurídico brasileiro formalmente em 2010, através da Resolução nº 125 do Conselho Nacional de Justiça e, por conseguinte, o grande crescimento de sua utilização, apura-se a viabilidade de se utilizar deste método como tratamento adequado aos conflitos na seara fundiária e agrária amazônica. Objetiva-se, com isso dar um novo enredo a tais conflitos frequentemente judicializados, mas sem alcance de uma eficaz solução. Para tanto, a presente pesquisa baseia-se na análise bibliográfica de fontes relativas à mediação e ao conflito fundiário e agrário, partindo do método dedutivo. Deste modo, observa-se que a real compreensão das técnicas da mediação, permite reconhecer a capacidade de adaptação do método mediativo aos conflitos em análise e superar as problemáticas que se colocariam como supostos empecilhos para a utilização da mediação – principalmente a desigualdade das partes e a indisponibilidade dos interesses públicos –, permitindo concluir pela viabilidade da sua utilização a fim de tratar adequadamente os conflitos fundiários e agrários.

Abstract:
Considering the input of mediation as a “ADR” in the Brazilian legal system formally in 2010, through Resolution n. 125 from of the National Council of Justice and, consequently, the great growth of its use, the viability of using this is verified, as an appropriate treatment method for conflicts in the Amazon land and agrarian field. The objective is, with this, to give a new plot to such conflicts that are often judicialized, but without reaching an effective solution. Therefore, this research is based on the bibliographic analysis of sources related to mediation and land and agrarian conflict, based on the deductive method. Thus, it is observed that the real understanding of the mediation techniques, allows to recognize the capacity of adaptation of the mediation method to the conflicts under analysis and to overcome the problems that would be put as supposed obstacles to the use of mediation - mainly the inequality of the parties and the unavailability of public interests -, allowing to conclude by the viability of its use in order to properly deal with land and agrarian conflicts.
