Abstract: Following the Judiciary reform, the National Council of Justice (CNJ) implemented a new social policy aimed at organizing and consolidating, on a national level, not only the services provided within judicial proceedings but also other mechanisms for conflict resolution. Among these mechanisms, non-adversarial methods such as mediation stand out. In the context of Family Law, family mediation proves to be an appropriate tool for resolving conflicts related to child custody. In order for joint custody to be effectively applied, at least a minimum level of dialogue between parents is required, since all decisions concerning the children must be made jointly. However, misunderstandings and resentment are commonly present at the end of a romantic relationship. In this regard, family mediation is essential to enable the implementation of joint custody, as it helps parents develop the necessary understanding to distinguish between conjugality — which ends — and parenthood — which remains. Therefore, the principles of responsible parenthood and the best interests of the child must be observed. This research adopted the deductive method, based on a literature review concerning Family Law, with emphasis on the institute of joint custody and the relevance of family mediation, as provided for in both the Mediation Law and the New Code of Civil Procedure, as a fundamental tool for the implementation of this custody model.
