Abstract: This article analyzes the legal and constitutional biases of motherhood as a factor of discrimination in the labor market and how these women's rights are protected. Despite advances in legislation and society, women still face difficulties entering the labor market, especially after pregnancy. The research question focuses on the following: how can pregnancy impact the guarantee of women's rights? The research will be bibliographical and documentary in nature, analyzing relevant legislation, such as human and labor rights, as well as case law and public policies on the topic, and reviewing related academic works. Thus, it is concluded that this topic is of paramount importance for sparking reflection on the role of public policies in protecting women and highlighting the need to expand current legislation to facilitate the balance between work and family life.
