A LEI Nº 13.097/2015 E A SEGURANÇA NOS NEGÓCIOS JURÍDICOS DE COMPRA E VENDA DE IMÓVEIS
O presente estudo tem como objetivo analisar a segurança nos negócios jurídicos imobiliários de compra e venda, face a Lei nº 13.097/2015 a qual contempla o Princípio da Concentração na Matrícula e busca trazer maior segurança nos negócios imobiliários. Tal lei em vigência desde 20/01/2015, dentre várias atribuições trouxe a possibilidade do credor averbar na matrícula do imóvel sua demanda, tornando-a pública de forma a garantir que o devedor não se desfaça do bem, garantindo assim a eventual execução, por outro lado, torna eficaz o negócio jurídico de compra e venda a atos precedentes que não tenham sidos averbados na matrícula do imóvel.

Abstract:
The present study aims to analyze the security in real estate purchase and sale legal transactions, in view of Law No. This law in force since 01/20/2015, among several attributions, brought the possibility for the creditor to record his demand in the registration of the property, making it public in order to guarantee that the debtor does not dispose of the asset, thus guaranteeing the eventual execution, on the other hand, it makes effective the legal transaction of purchase and sale to precedent acts that have not been recorded in the registration of the property.
