A LEI DE REGISTROS PÚBLICOS E SUA INADEQUAÇÃO A QUESTÃO DE INCONGRUÊNCIA DE GÊNERO PERCEBIDA PELOS TRANSEXUAIS: POSSIBILIDADES E DESAFIOS PARA ADEQUAÇÃO À REALIDADE DA PERCEPÇÃO DE GÊNERO A IDENTIDADE CIVIL.
O presente trabalho pretende
estudar a Lei de Registros Públicos no tocante
a mudança de prenome e de sexo jurídico nos
documentos de identificação civil da população
transexual. Tem a intenção de analisar, as
possibilidades e os desafios jurídicos de uma
adequação da identidade civil a realidade
social do transexual, sob a ótica do princípio da
dignidade da pessoa humana, com o objetivo de
garantir ao transexual a retificação do registro
civil permitindo o uso do gênero, mesmo sem
a realização da cirurgia de transgenitalização.
O texto faz uma análise da Lei 6.015/73 frente
ao sistema jurídico brasileiro atual. Através de
métodos objetivos e de pesquisas bibliográficas,
o artigo discorre a respeito da busca por uma
melhor prestação jurisdicional. Destarte, através
do estudo, pretende-se provar a importância
de uma discussão crítica sobre a matéria no
cenário atual visando uma regulamentação
jurídica e uniforme para a população transexual.

Abstract:
The present work intends to study
the Law of Public Records in relation to change
of name and legal sex in the documents of civil
identification of the transsexual population. It
intends to analyze the possibilities and legal
challenges of an adaptation of the civil identity
to the social reality of the transsexual, from
the point of view of the principle of the dignity
of the human person, with the purpose of
guaranteeing to the transsexual the rectification
of the civil registry allowing the use of the genus,
even without performing the transgenitalization
surgery. The text analyzes Law 6.015 / 73 in
relation to the current Brazilian legal system.
Through objective methods and bibliographical
research, the article discusses the search for
better jurisdictional performance. Thus, through
the study, we intend to prove the importance of
a critical discussion on the subject in the current
scenario aiming at a uniform and legal regulation
for the transsexual population.
