A LEI 13.491/2017 E OS SEUS REFLEXOS NA JUSTIÇA MILITAR
O presente trabalho aborda os reflexos da alteração do Código Penal Militar, em que foi ampliada a competência da Justiça Militar para o processamento e julgamento de crimes militares. Nesse sentido, se constata uma mudança substancial no sistema judicial brasileiro, em especial quando diz respeito aos crimes praticados pelos policiais militares dos Estados, remetendo à Justiça Castrense o processo e julgamento dos crimes praticados por estes agentes, quando em serviço ou em razão da função. Por ser uma alteração legislativa de conteúdo não apenas processual, mas também material, demanda a observância de diversos institutos previstos na legislação penal, bem como gera discussões quanto ao âmbito de sua incidência, motivando debates através da doutrina e a busca de solução das controvérsias por parte da jurisprudência.

Abstract:
This work addresses the reflections of the amendment of the Military Penal Code, in which the competence of Military Justice for the processing and prosecution of military crimes was extended. In this sense, a substantial change in the Brazilian judicial system can be seen, especially when it comes to crimes committed by military police officers of the states, referring to Castrense Justice the process and trial of crimes committed by these officers, when in service or because of the function. As it is a legislative change of content not only procedural, but also material, it demands the observance of several institutes provided for in the criminal legislation, as well as it generates discussions as to the scope of its incidence, motivating debates through the doctrine and the search for a solution to the controversies by the jurisprudence.
