A LEGITIMIDADE DA DEFENSORIA PÚBLICA PARA A TUTELA DO O MEIO AMBIENTE: ATUAÇÃO COLETIVA EM PROL DOS NECESSITADOS.
A pesquisa tem por objetivo analisar se a Defensoria Pública, enquanto instituição essencial à justiça e responsável pela prestação de assistência jurídica gratuita e promoção dos direitos humanos, tem legitimidade para a tutela na defesa do meio ambiente. A pesquisa se justifica tendo em vista a relevância do tema: a questão ambiental é uma das maiores (senão a maior) emergência planetária, sendo sua proteção condição de possibilidade da existência da vida humana e não humana. Num primeiro momento, identificou-se o perfil da Defensoria Pública, especialmente pós a edição da Constituição Federal de 1988 e sucessivas emendas que consagram a autonomia da instituição, além de outras conquistas como a determinação constitucional de legitimidade para a tutela coletiva e a sua relação com as ondas renovatórias de acesso à justiça. À frente, é analisada a questão ambiental a partir do direito da sustentabilidade, vertente que parece ser a adequada à luz das catástrofes ambientais e, de modo geral, pela política de não direito ambiente existente. Por fim, em sede de síntese, os pontos anteriores são entrelaçados, de modo a permitir verificar se possui a Defensoria Pública legitimidade para a tutela ambiental. Para a realização da pesquisa foi utilizado o método indutivo na fase de investigação, somado às técnicas do referente, da categoria, dos conceitos operacionais, da pesquisa bibliográfica e do fichamento. Ao final, , pode-se concluir pela legitimidade da Defensoria Pública para atuar na defesa e promoção do meio ambiente.

Abstract:
The research aims to analyze whether the Public Defender's Office, as an institution essential to justice and responsible for providing free legal assistance and promoting human rights, has legitimacy to protect the environment. The research is justified in view of the relevance of the theme: the environmental issue is one of the biggest (if not the biggest) planetary emergencies, its protection being a condition of the possibility of the existence of human and non-human life. At first, the profile of the Public Defender was identified, especially after the edition of the 1988 Federal Constitution and successive amendments that enshrine the institution's autonomy, in addition to other achievements such as the constitutional determination of legitimacy for collective protection. Ahead, the environmental issue is analyzed based on the right to sustainability, an aspect that seems to be the appropriate one in the light of environmental catastrophes and, in general, by the existing policy of non-environmental law. Finally, in summary, the previous points are intertwined, in order to verify whether the Public Defender's Office has legitimacy for environmental protection. In order to carry out the research, the inductive method was used in the investigation phase, added to the techniques of the referent, category, operational concepts, bibliographic research and file. Finally, it can be concluded that the Public Defender’s Office is legitimated to persecute and protect environmental matters.
