The purpose of this study is to analyze whether or not such a system, which takes into account the hypothesis of privileged trafficking and the prohibition of such conversion, violates the constitutional text in the light of the principles of individualization of sentence and proportionality, time in which it foresees less culpability for the privileged traffic, it chooses the more violent form as consequent sanction. Initially, a brief report is presented on the origin of the sentence, as well as on the constitutional principles of these. Then there is a study on the Brazilian Criminal Justice, going through retributive justice and restorative justice, then begins to analyze the crime of privileged trafficking and the possibility of applying alternative penalties to the offender. The aim of this research is to analyze and interpret the penal system to identify the viability of its application in the state of Amazonas, in view of the state's public security policy, considering that it is urgent to seek alternatives to the current public security framework, especially the prison system adopted, not only in Amazonas, but throughout the country. It also discusses Alternative Feathers and Restorative Justice. Informs and analyzes numbers referring to the number of occurrences of the criminal type under study as well as the amount of alternative penalties applied in cases of offenders by privileged trafficking, referring to the periods of 2017 and 2018 in Manaus.
