A JUSTIÇA EM LUGAR DO CURTO-CIRCUITO DA VINGANÇA: UMA VISÃO DA ORÉSTIA E DA EDUCAÇÃO PÚBLICA PARA A EQUIDADE DE PAUL RICOEUR
Parte-se da ideia de justiça e suas implicações com a vingança. A conexão entre o direito e o trágico é analisada através da trilogia Oréstia, de Ésquilo, representativa da justiça vingativa. Articula-se o estudo com o pensamento de Paul Ricoeur sobre a justiça. Ricoeur emprega a expressão “curto-circuito da vingança” como ponto de partida para explicar o fenômeno da vingança em O justo1 (2008). A pesquisa apresenta a visão da educação pública para a equidade, noção resgatada por Ricoeur (2008a), para romper com a oposição entre justiça e vingança. Trata-se de um enfoque conceitual e descritivo, de natureza interdisciplinar entre literatura e direito.

Abstract:
The idea of justice and its implications for revenge is the starting point of this work. The connection between law and the tragic is analyzed through The Oresteia trilogy, by Aeschylus, representing the vindictive justice. The study is related to Paul Ricoeur´s thought about the concept of the just. Ricoeur uses the expression “short-circuit of vengeance” in order to explain the phenomenon of the desire of vengeance in The just (2000). The research presents the vision of the public education about fairness, a notion shown by Ricoeur (2000), to overcome the opposition between justice and vengeance. The article has a conceptual and descriptive approach, of an interdisciplinary nature between literature and law.
