A JURISPRUDÊNCIA DA CORTE INTERAMERICANA DE DIREITOS HUMANOS NA APLICAÇÃO DA JURISDIÇÃO MILITAR NO JULGAMENTO DE DELITOS COMUNS
O presente trabalho pretende examinar a compatibilidade da aplicabilidade da jurisdição militar no julgamento de delitos comuns com as decisões da Corte Interamericana de Direitos Humanos. O Brasil submete-se ao Pacto São José da Costa Rica como também às decisões do Tribunal Americano. Em novembro de 2017 foi publicada, no Diário Oficial da União, a Lei Nº 13.491/2017 que alterou o Art 9º do Código Penal Militar, ao ampliar a competência da Justiça Militar abrangendo os delitos comuns. Assim, questiona-se a conformidade da modificação legislativa com a jurisprudência americana. A pesquisa é qualitativa, descritiva e bibliográfica.

Abstract:
This paper aims to examine the compatibility of the applicability of military jurisdiction in the judgment of common crimes with the decisions of the Inter-American Court of Human Rights. Brazil submits to the San José Pact of Costa Rica as well as to the decisions of the American Court. In November 2017, Law No. 13.491 / 2017 was published in the Official Gazette of the Union, which amended Article 9 of the Military Penal Code, by extending the jurisdiction of the Military Justice to include common crimes. Thus, the conformity of the legislative modification with American jurisprudence is questioned. The research is qualitative, descriptive and bibliographic.
