A judicialização do Benefício de Prestação Continuada
Este artigo é parte da pesquisa de mestrado que investigará o processo de judicialização do Benefício de Prestação Continuada – BPC. Sendo um direito social previsto na CF/88 e na LOAS, não está sendo acessado por parcela da população e diante da negação do benefício pela via administrativa (benefícios indeferidos pelo INSS), a judicialização vem configurando-se como mecanismo de garantia de acesso aos que dele necessita. Justifica-se a necessidade de compreender a política de proteção social, o BPC, sobre seus critérios de elegibilidade aplicados. Indaga-se como o cidadão poderá recorrer para ter acesso aos seus direitos? Pode também faltar o conhecimento para chegar aos mecanismos que visam sua garantia?

Abstract:
This article is part of the master's research that will investigate the process of judicialization of the Continuous Benefit Benefit - BPC. Being a social right provided for in CF / 88 and LOAS, it is not being accessed by part of the population and due to the denial of the benefit through administrative means (benefits denied by the INSS), judicialization has been configured as a mechanism to guarantee access to you need it. The need to understand the social protection policy, the BPC, is justified on its applied eligibility criteria. Do you wonder how the citizen can appeal to gain access to their rights? Could it also lack the knowledge to arrive at the mechanisms that aim to guarantee it?
