Abstract: Despite the right to health being a duly institutionalized fundamental guarantee, the State has not supported the basic principles of this system, demonstrating vulnerability to universal and equal care. For this reason, users of the Unified Health System (SUS) have sought the intermediation of the Judiciary in an attempt to obtain favorable court decisions to coerce the Public Administration to comply with the constitutional precepts to give effect to the right to health. The objective was to identify the criteria adopted in the decisions of the Court of Justice of the State of Tocantins (TJTO), during the COVID-19 pandemic, in the demands that dealt with the provision of ICU beds to patients with advanced disease
