A INSUSTENTABILIDADE DA TEORIA DA PREVENÇÃO ESPECIAL POSITIVA DIANTE DA FILOSOFIA DE JEAN-PAUL SARTRE
O presente estudo pretende realizar uma abordagem teórica e filosófica acerca do conceito de liberdade formulado pelo filósofo Jean-Paul Sartre, para, posteriormente, questionar os fundamentos da pena privativa de liberdade, especialmente a teoria da prevenção especial positiva. Para tanto, será realizada, inicialmente, uma análise da construção filosófica e existencialista sartreana. Posteriormente, será efetuada uma abordagem da estrutura do sistema de justiça criminal, identificando quais as teorias que objetivaram legitimar historicamente sua existência e atuação, com especial enfoque nas teorias da prevenção especial, as quais que atribuem à pena a função de evitar a reincidência pela via da ressocialização e da reintegração social do apenado.

Abstract:
This study aims to make a theoretical and philosophical approach to the concept of freedom formulated by the philosopher Jean-Paul Sartre, to subsequently question the foundations of the custodial sentence, especially the theory of positive special prevention. To do so, we will first analyze the Sartrean philosophical and existentialist construction. Subsequently, an approach will be made to the structure of the criminal justice system, identifying which theories have historically legitimized its existence and performance, with special focus on the theories of special prevention, which attribute to the penalty the function of preventing recidivism through resocialization and social reintegration of the convicted.
