Abstract: This article intends to analyze the factors that influence the achievement of recognition, such as memories, false memories and social stigmas. And address the fragility of the recognition procedure as evidence, emphasizing the organization "The Innocence Project" and the need to reduce damage caused by wrongful convictions, caused by only this means of proof, which may contain flaws and vices. The subject has great social importance in criminal proceedings, taking into account that in testimonial evidence the chances of errors are very high, in view of its fragility.
