Abstract: This study analyzes the practice of epistemic injustice by the Public Prosecutor's Office in criminal proceedings, exploring how the institution, in exercising its accusatory function, often disregards evidence favorable to the defense and reinforces the state narrative. The research discusses penal selectivity and the impacts of overvaluing the statements of authorities, especially in cases of mistaken photographic recognition. Using theoretical references such as Ferrajoli, Aury Lopes Jr., and Janaína Matida, as well as reports from the Public Defender's Office, the study highlights how this practice undermines guarantee-based principles, contributes to judicial errors, and reinforces structural inequalities in the criminal justice system. Finally, the study proposes the need for greater oversight of prosecutorial actions to ensure a fairer and more balanced criminal process.
