A INFLUÊNCIA DA ESCOLA DA LIVRE CRIAÇÃO DO DIREITO E DA HERMENÊUTICA CONSTITUCIONAL NAS DECISÕES JUDICIAIS BRASILEIRAS
Para a Escola da Livre Criação do Direito, o único modo de solucionar o problema do direito legislado, lacunoso por essência, seria por meio da liberdade do magistrado para resolver os conflitos ao proferir a sentença. A Hermenêutica Constitucional estuda e sistematiza os processos buscando aflorar o espírito das leis, ao nortear não somente o labor exegético, mas também os mecanismos de colmatação de lacunas normativas e os critérios idôneos. O objetivo da pesquisa foi analisar como essa escola do pensamento jurídico e a Hermenêutica Constitucional têm influído sobre as decisões judiciais no Brasil. O estudo trata-se de uma revisão de literatura, desenvolvido a partir do método dedutivo de abordagem combinado com o procedimento bibliográfico de pesquisa. Reconheceu-se que as ideias da referida escola influem sobre as decisões judiciais a partir do estímulo à formação da convicção subjetiva com liberdade por parte do magistrado, o qual pode mascará-la por meio da argumentação jurídica justificadora da sua decisão. Notou-se que, por meio do desenvolvimento da tarefa hermenêutico-jurisdicional, as decisões do STF concretizam as normas constitucionais, ressalvando-se a importância da aplicação conjunta dos princípios e métodos da hermenêutica contemporânea e da abordagem clássica aliada com a técnica de ponderação de valores, a fim de solucionar casos em que preceitos constitucionais são violados. Concluiu-se que as ideias da Escola da Livre Criação do Direito têm possibilitado que decisões contra legem sejam proferidas na prática judiciária e que a adoção dos princípios e métodos da Hermenêutica Constitucional pelo Pretório Excelso nos casos envolvendo controle de constitucionalidade ou antinomias jurídicas têm promovido a efetividade da justiça.

Abstract:
For the School of Free Creation of Law, the only way to solve the problem of legislated law, which is essentially flawed, would be through the magistrate's freedom to resolve conflicts when delivering the sentence. Constitutional Hermeneutics seeks to study and systematize the processes seeking to bring out the spirit of the laws, by guiding not only the exegetical work, but also the mechanisms for filling normative gaps and the suitable criteria. The objective of the research was to analyze how the School of Free Creation of Law and Constitutional Hermeneutics have influenced judicial decisions in the national territory. The study is a literature review, developed from the deductive method of approach combined with the bibliographic research procedure. It was recognized that the ideas of this school influence judicial decisions by stimulating the formation of subjective conviction with freedom on the part of the magistrate, who can mask it through legal arguments justifying his decision. It was noted that, through the development of the hermeneutic-jurisdictional task, the decisions of the STF concretize the constitutional norms, emphasizing the importance of the joint application of the principles and methods of contemporary hermeneutics and the classical approach allied with the technique of weighting of values, in order to resolve cases in which constitutional precepts are violated. It was concluded that the ideas of the School of Free Creation of Law have made it possible for decisions against legem to be rendered in judicial practice and that the adoption of the principles and methods of Constitutional Hermeneutics by the Federal Supreme Court in cases involving control of constitutionality or legal antinomies has promoted the effectiveness of justice.
