A INEFICÁCIA DAS MEDIDAS ADOTADAS NO ESTADO DE COISAS INCONSTITUCIONAL E A COVID-19 NAS PRISÕES BRASILEIRAS
Este artigo reflete sobre crise do sistema carcerário brasileiro. O objetivo foi estudar a conjuntura do Estado de Coisas Inconstitucional (ECI) seis anos após o reconhecimento pelo Supremo Tribunal Federal, bem como os reflexos no sistema prisional da pandemia da Covid-19, a partir de uma revisão bibliográfica e de dados públicos referentes às prisões brasileiras. Como principais conclusões, foi possível argumentar, diante da persistência do quadro violador de direitos fundamentais nas prisões anos após o reconhecimento do ECI, que há uma ineficiência nas políticas adotadas, havendo a necessidade de se repensar a política criminal e penitenciária. Além disso, a partir da literatura e de estudos prévios sobre o tema constatou-se que todos os Poderes vem contribuindo para manutenção do ECI no país, inclusive por parte do próprio STF, que se utiliza de justificativas para evitar o aumento da demanda de trabalho, deixando de analisar violações da dignidade humana até mesmo durante a pandemia.

Abstract:
This article deals with the crisis in the Brazilian prison system. The objective was to study the situation of the Unconstitutional State of Affairs six years after recognition by Brazil's Supreme Court (STF), as well as the effects on the prison system of the Covid-19 pandemic, based on a bibliography review and public data on the Brazilian prisons. As main effects, it was possible to argue, given the persistence of the violation of fundamental rights in prisons years after recognition by the Unconstitutional State of Affairs, that the adopted policies are inefficient, which evidences the need to rethink the criminal and prison policy. In addition, based on the literature and previous studies on the subject, it was found that all Republic Powers have been contributing to the maintenance of the Unconstitutional State of Affair in the country, including the STF itself, which uses justifications to avoid the increase in the demand for work, failing to analyze violations of human dignity even during a pandemic.
