A INCLUSÃO ESCOLAR DA PESSOA COM DEFICIÊNCIA E A LEGISLAÇÃO NO CONTEXTO ATUAL
Este estudo se constitui em uma revisão dos aspectos legais do acesso de
aluno público alvo da educação especial nas escolas em classes regulares. Trata-se
de uma revisão bibliográfica e exploratória através de análise de documentos como
a Constituição Federal, a LDB e suas regulamentações como também documentos
internacionais. O objetivo deste artigo é contribuir para ampliação do debate politico
e educacional sobre os aspectos legais que garantem o direito a inclusão escolar da
pessoa com deficiência intelectual e, consequentemente, a construção de uma
sociedade democrática, justa e acolhedora que respeita e aceita a diversidade.

Abstract:
This study constitutes a review of the legal aspects of the access of public
students, wich are the target group to special education in schools in regular classes.
It is a bibliographical and exploratory review through analysis of documents such as
the Federal Constitution, LDB and its regulations as well as international documents.
The objective of this article is to contribute to broadening the political and educational
debate on the legal aspects that guarantee the right to school inclusion of the person
with intellectual disability and, consequently, the construction of a democratic, fair
and welcoming society that respects and accepts diversity.
