A INCIDÊNCIA DO CRIME DE ASSÉDIO SEXUAL NA RELAÇÃO PROFESSOR-ALUNO
O presente artigo tem como objetivo discutir a possibilidade da aplicação da tipificação do crime de assédio sexual na relação entre professor-aluno, uma vez que o título penal fala em relação hierárquica ou ascendência inerente ao emprego, cargo ou função. Para alcançar o objetivo explanaremos sobre a evolução do crime de assédio sexual, a importância do docente na vida dos alunos, posição do aluno na estrutura organizacional do sistema de ensino, apresentaremos diferentes posições da doutrina, através de um embate dialético, vez que, parte da doutrina entende não ser possível a configuração do delito, por não ser previsto no tipo penal, uma vez que não haveria uma relação empregatícia, por outro lado, outros doutrinadores entendem que a relação empregatícia não é uma exigência, sendo perfeitamente enquadrada na situação de ascendência inerente ao emprego, cargo ou função. O tema é controverso, tendo chegado aos Tribunais Superiores para decidir as demandas. Por fim, apresentaremos a posição da jurisprudência atual, com entendimento que vem se firmando com decisões repetitivas.

Abstract:
This article has the objective aims to discuss the possibility of applying the typification of the crime of sexual harassment in the relationship between student and teacher, once the criminal title speaks in a hierarchical relationship ancestry inherent in employment, position or function. To achieve the objective we will explain about the evolution of the crime of sexual harassment, the importance of the teacher in the life of students, the position of the student in the organizational structure of the education system, we will present different positions of the doctrine, through a dialectical clash, since part of the doctrine considers that it is not possible to set up the crime, because it is not provided for in the criminal type, since there would be no employment relationship, on the other hand, other indoctrinators understand that the employment relationship is not a requirement and is perfectly framed in the situation of ancestry inherent in employment, position or function. The issue is controversial, having reached the High Courts to decide the demands. Finally, we will present the position of the current jurisprudence, with the understanding that it has been established with repetitive decisions.
