A (IN) EXCLUSÃO DO SUJEITO INDÍGENA NO CÓDIGO CIVIL PELAS ALTERAÇÕES DA LEI 13.146/2015
O presente trabalho busca problematizar o discurso jurídico da Lei n. 13.146/2015 (Estatuto da Pessoa com Deficiência), que traz alteração no atual Código Civil, para tratar da capacidade dos indígenas no Brasil. Para tanto, faz-se uma abordagem da ocorrência de acontecimentos discursivos (trans)formadores da memória discursiva, dos processos de constituição dos sentidos e dos sujeitos frente as relações de poder que permeiam o indígena na sociedade. Pauta-se nos fundamentos de Foucault, com suporte metodológico na arqueogenealogia foucaultiana e toma por base as reflexões trazidas por Pêcheux quanto as noções de sujeito, memória e acontecimento discursivo. Parte-se da hipótese de que os avanços sociais, culturais, políticos e discursivos voltados para as tentativas de inclusão do sujeito indígena, provocam efeitos discursivos diversos, que dificultam a sua legitimidade como sujeito de direitos fundamentais. E questiona-se se as tentativas de inclusão do sujeito indígena não terminam por excluí-lo socialmente, assim mitigando sua capacidade como sujeito de direitos.

Abstract:
The present work seeks to problematize the legal discourse of Law n. 13.146/2015 (Statute of Persons with Disabilities), which amends the current Civil Code, to address the capacity of indigenous people in Brazil. To do so, an approach is made to the occurrence of discursive events (trans)formers of discursive memory, processes of constitution of meanings and subjects facing the power relations that permeate the indigenous in society. It is based on the foundations of Foucault, with methodological support in Foucault's archeogenealogy and is based on the reflections brought by Pêcheux regarding the notions of subject, memory and discursive event. It starts from the hypothesis that the social, cultural, political and discursive advances aimed at the attempts to include the indigenous subject, provoke diverse discursive effects, which hinder its legitimacy as a subject of fundamental rights. And it is questioned whether the attempts to include the indigenous subject do not end up excluding him socially, thus mitigating his capacity as a subject of rights.
