A IMPORTÂNCIA DO NEXO DE CAUSALIDADE NAS AÇÕES DE RESPONSABILIDADE CIVIL MÉDICA
Este estudo aponta algumas dificuldades e nuances que a responsabilidade civil médica apresenta ao profissional advogado que milita nesta área, bem como aponta a importância da análise da documentação comprobatória em fase anterior ao ajuizamento da demanda judicial. O objetivo é o de avaliar a importância do nexo de causalidade em demandas judiciais em face dos profissionais médicos. Para se chegar ao objetivo, na primeira seção trata-se do tipo de responsabilidade civil do médico. Na segunda seção, explana-se a importância do nexo de causalidade nas obrigações médicas. Após, faz-se uma análise da importância do nexo de causalidade na configuração do erro médico. No desenvolvimento da pesquisa utiliza-se de forma preponderante método indutivo como base lógica, e o cartesiano na fase de tratamento dos dados. Conclui-se que o advogado deve ter como foco primordial, nas demandas judiciais da área médica, o nexo de causalidade, sendo que caso, na fase antecipada do ingresso da ação, não vislumbre este nexo, não deve insistir em aventuras jurídicas.

Abstract:
This study points out some difficulties and nuances to what civil medical liability presents to lawyers who militate in these issues as well point out the importance of probatory documental analysis before the presentation of the judicial demand. The justification for this work is the amount of actions that, due to the lack of the nexus of causality in the characterisation of the medical error, are considered unfounded by the judge. In order to reach the objective, the first section its treat the type of civil responsibility of the medic. In the second section, its explains the importance of the nexus of causality in medical obligations. After, it is made an analysis of the importance of the nexus of causality in the configuration of the medical error. In the development of the research, a preponderant inductive method is used as a logical basis, and the Cartesian method is used in the data processing phase. The conclusion is that the lawyer should try to the utmost to explain and find the nexus of causality of the medical error and, if it is not possible, should not insist on the cause.
