Abstract: This article will discuss the democratization of legal education in Brazil and the role of quota policies, as an affirmative action, in this process. The constitutionally guaranteed fundamental rights involved in this public policy will also be analyzed. Initially, this paper aims to provide a brief historical contextualization on so-called affirmative action (or reservation policies, in India), as well as to explore the concepts and definitions attached to the term that are relevant to the deepening of the discussion. It will then explore the impacts of these policies on the democratization of legal higher education, historically marked by being a high status course and, for this very reason, with a demand that is more geared towards the country's elite. Finally, it will discuss the constitutional aspects surrounding the discussion about the quota policy and the Magna Carta as a mechanism for implementing, fostering and guaranteeing the maintenance of its application.
