A IMPORTÂNCIA DA PROTEÇÃO JURÍDICA DO GÊNERO FEMININO INDEPENDENTE DE SUA ORIENTAÇÃO SEXUAL
No decorrer dos anos as relações de afeto se atualizaram então há, cada vez mais a necessidade de o Estado proteger os envolvidos nas respectivas relações. Frisa-se que há a falta da especificação de legislação para aos que se identificam ser do gênero feminino, bem como protege-las quando necessário em uma situação de violência doméstica e a figuração de sujeito passivo, pois a Lei Maria da Penha, a lei nº 11.340/06, tem o explicito entendimento de que apenas esse lugar está assegurado para as denominadas mulheres biologicamente do sexo feminino. Destarte, o presente trabalho tem como objetivo elencar as vulnerabilidades da Lei supracitada, bem como realizar a diferenciação entre a questão de se identificar como do gênero feminino e ser do sexo biologicamente feminino. O presente artigo tem o objetivo de demonstrar a importância da proteção do gênero feminino independente da orientação sexual do mesmo, pois apesar dos entendimentos favoráveis dos juízes, não há previsão no ordenamento jurídico explícito para essa proteção. Ademais, o presente trabalho é somente a ponta de uma indagação necessária para todo um contexto, e a conclusão de que precisa ocorrer uma mudança urgente. O método utilizado será o hipotético-dedutivo.

Abstract:
Over the years, the relationships of affection have been updated, so there is an increasing need for the State to protect those involved in the respective relationships. It is emphasized that there is a lack of specification of legislation for those who identify themselves as being female, as well as protecting them when necessary in a situation of domestic violence and the figuration of a passive subject, as the Maria da Penha Law, the law nº11.340/06, has the explicit understanding that only this place is guaranteed for the so-called biologically female women. Thus, the present work aims to list the vulnerabilities of the aforementioned Law, as well as to differentiate between the issue of identifying oneself as female and being biologically female. This article aims to demonstrate the importance of protecting the female gender regardless of her sexual orientation, because despite the favorable understandings of the judges, there is no provision in the explicit legal system for this protection. Furthermore, the present work is only the tip of a necessary inquiry for an entire context, and the conclusion that an urgent change needs to occur. The hypothetical-deductive method will be used.
